Article 1: Definitions

1.1 Proyecto Peru Centre S.A.C. for language courses, Proyecto Peru Internships in Cusco for internship placements in Peru and Proyecto Peru Travel Agency for all other services like accommodation, volunteer work in Peru and tours. Proyecto Peru is responsible for the execution of the agreement. Proyecto Peru has its office at Siete Cuartones 290, Cusco, Peru.

1.2 The student is the person or client who comes to an agreement with Proyecto Peru.

1.3 The beginning of the program is the first day of lessons, accommodation, volunteer work, internship placement, tour or the day of the airport pick-up in Cusco: depending which is first.

Article 2: Language Courses and Program Activities

2.1 Unless otherwise agreed, the first day of the language course is on a Monday and the last day of the course is on a Friday.

2.2 There will be no classes on the following public holidays: 1st of January, Good Friday, 24th of June, 28th of July, 1st of November and 25th of December. On some days there will be an alternative activity.

2.3 Proyecto Peru has the right to determine the timetable of the lessons.

2.4 In case of group lessons, Proyecto Peru holds the right to form the group. Proyecto Peru will make an effort to form a group of students with the same level.

2.5 In case of group lessons, the maximum group size will be 4 students.

2.6 If a student registers for group lessons and Proyecto Peru cannot form a group of students with the same level, there are 2 options:

2.6.1 If the student applied for group lessons of 20 hours per week (4 hours per day), the student will receive an individual course of 15 hours per week (3 hours per day) for the same price.

2.6.2 If the student applied for any other program of group lessons (thus not for 20 hours per week), the student is obliged to do an individual course of the same amount of hours and pay the difference on the first day of classes.

2.7 Examples of free activities running during the language courses are an indication of possible activities. Some activities may not run at all or may be substituted by other activities.

Article 3: Accommodation

3.1 The student is obliged to follow the accommodation rules provided by the school and/or the guest family or apartment owner.

3.2 No overnight guests are allowed. The student is responsible for the acts of all guests (whether premitted or not) at the apartment during the stay.

3.3 Smoking is not allowed in shared apartments.

3.4 Pets are not allowed in shared apartments.

3.5 For registrations received a month or less prior to the beginning of a program, Proyecto Peru does not guarantee the type of accommodation desired and requested by the student because priority is given to those students who have registered further in advance.

3.6 In the event that a student is not satisfied with the assigned accommodation and is rightfully justified in his or her claim, he/she will be allowed one change to another accommodation of the same type.

Article 4: Tours

4.1 Payments for tours, excursions or trips do not form part of our refund policy as stated in article 6 & 7.

4.2 In case of cancellation: the total payment minus the costs of reservations made by third parties (transport, hotel, entrance fees, permit) can be refunded. Refunds of services reserved by third parties depend on the general conditions of these third parties. This means that most tours have little or no refund as cancellation policies of third parties are strict in Peru. There is no refund for cancellation of the 4 day Inca Trail.

4.3 In case of a refund: costs of the international money transfer will be paid by the student.

4.4 Tours, excursions, trips, itineraries and arrangements all are subject to change without notice, although we will try to give you notice as soon as possible. We reserve the right to rearrange the itinerary and to substitute or delete activities from the schedule if this becomes necessary due to local conditions, the convenience of the parties or the proper and safe conduct of the tour. If this happens, we will try to provide you with alternate arrangements of comparable quality.

Article 5: Airport Pickup and Lima Connection

5.1 Proyecto Peru provides Cusco pick-up for a student that books accommodation with Proyecto Peru. The pick-up will be provided in Cusco city on the day that you start your accommodation.

5.2 The student is obliged to inform Proyecto Peru of the details of the flight/bus of arrival to Cusco and to Lima if using the Lima Connection Service at least 5 days in advance. Proyecto Peru will not be able to arrange the airport pickup, if a student sends incomplete information or sends the information too late or if there are last-minute changes.

Article 6: Cancellation and Modifications of Language Course

6.1 Only a notice of cancellation by e-mail by a student is accepted as a cancellation.

6.2 In case an agreement for a language course is cancelled by a student the received payment of a student will be refunded.

6.3 A student can postpone a class if a student has private lessons and if a student informs Proyecto Peru at least 1 day in advance.

6.4 Proyecto Peru cannot be held responsible for cancellations due to health or personal problems of a student.

6.5 In case of a refund: costs of the international money transfer will be paid by the student.

Article 7: Cancellation and Modifications of Accommodation

7.1 Only a notice of cancellation by e-mail by a student is accepted as a cancellation.

7.2 In case an agreement for accommodation is cancelled by a student, the student is obliged to pay the following parts of the total sum:

7.2.1 In case of cancellation of accommodation up to 15 days before the beginning of a program: the received payment of a student for the accommodation will be refunded minus an administration fee of 150 Soles.

7.2.2 In case of a cancellation from the 15th day before the beginning of a program through to the end of a program, the student will be refunded for 50% of the cancelled part.

7.3 Proyecto Peru cannot be held responsible for cancellations due to health or personal problems of a student.

7.4 In case of a refund: costs of the international money transfer will be paid by the student.

Article 8: Cancellation and Modifications by Proyecto Peru

8.1 Proyecto Peru reserves the right to cancel or modify any program due to circumstances that make it impossible to complete with the students program or to guarantee the safety of our staff or the safety of the student (like war, natural disasters and strikes).

8.2 The agreement is dissolved by notice of cancellation. Proyecto Peru will offer an alternative course similar to the cancelled course for the same price. If this offer is not accepted, then Proyecto Peru will return the total payment received by Proyecto Peru (total payment minus costs for international money transfer).

8.3 Proyecto Peru is not responsible for delays or cancellations of flights or from any other means of transport that influence the further program of a student. A student arriving after the beginning of a program will not be refunded for any unused portion.

Article 9: Volunteer and Internship Projects

9.1 Working hours are set by the internship or volunteer organization, in agreement with the intern / volunteer, in accordance with the requirements of normal business or as demanded by special situations and circumstances. Interns / volunteers will support the internship / volunteer organization, which shall set out the duties and responsibilities of the interns / volunteers and will respect and follow the rules of the organization.

9.2 The volunteer / intern is responsible for the possession of the correct travel documents, tickets, insurances and any required vaccinations.

9.3 The volunteer / intern is responsible for transportation from the accommodation to the volunteer project or internship organization and vice versa.

9.4 The volunteer / intern understands that Proyecto Peru cannot guarantee a specific placement or exact start date but will make every effort to meet this requests.

9.5 The volunteer / intern will be placed with a volunteer or internship organisation. In the event of problems, the volunteer / intern agrees to communicate immediately with the coordinator within the volunteer or internship organization as well as with Proyecto Peru. With any concerns or issues with the placement, the volunteer or intern will contact Proyecto Peru immediately.

9.6 If the volunteer / intern does not meet the expectations of the placement and loses the placement, Proyecto Peru is not responsible for finding another placement.

9.7 Holidays and days off must be planned in advance in agreement with the volunteer or internship organization of the placement.

9.8 In the event that the volunteer / intern leaves the placement prior to the agreed end date, no refund of fees or costs will be given.

9.9 Proyecto Peru reserves the right to cancel or modify any volunteer or internship program and placement due to circumstances that make it impossible to complete with the volunteer / internship program. If the agreed internship or volunteer placement can not be offered due to changed circumstances, Proyecto Peru will make every effort to find an alternative placement.

Article 10: Documents

10.1 The student is responsible for having the correct documents, visa and insurance.

10.2 In case a student needs a document confirming the acceptance into the course for a visa application, this document can only be issued by Proyecto Peru if the application form has been received and the total payment for the program has been made in advance.

10.3 In case the visa application fails, we will refund the total payment received (total payment minus costs for international money transfer), minus a $ 100 USD administration fee to the students bank account. The refund will only be made when Proyecto Peru receives a written notice by the student of the failure of the visa application at least 15 days prior to the start of the course and only when Proyecto Peru receives a copy of the official letter of visa denial from the embassy or consul where the student has applied.

Article 11: Privacy

11.1 Proyecto Peru does not sell your personal information to third parties.

11.2 Proyecto Peru may take promotional photographs and video footage of students. If students do not wish to participate, Proyecto Peru will respect their wishes.

11.3 Proyecto Peru may occasionally send news, such as information on our current events, special events happening during your stay, promotions etc. to your provided email address. If students do not wish to receive any email, Proyecto Peru will respect their wishes.

11.4 Students can be used as a reference for future students, Proyecto Peru may provide your name and email address to students that are interested and asking for a reference for example for a certain intern or volunteer placement that you participated in. If students do not wish to receive any email, Proyecto Peru will respect their wishes.

Article 12: Liability

12.1 The student is responsible for damage caused by illicit behavior.

12.2 The student who causes trouble in a way that heavily influences a proper continuation of the program can be excluded from further continuation of the program by Proyecto Peru. The costs which result from excluding will be accounted for by the student.

12.3 Students are not covered for any illnesses, accidents, loss of personal property (neither at their accommodation nor in or outside the classroom nor in tours nor in activities). Proyecto Peru cannot be held responsible. We recommend our students to take an insurance policy.

12.4 Proyecto Peru can not be held responsible for any loss, damage, delay or injury during the program.

Article 13: Payment

13.1 The total payment consists of the costs of the language course, accommodation, tours, Lima package and any additional services.

13.2 The total payment is based on the prices and exchange rate as known to Proyecto Peru on the day of enrollment.

13.3 Unless mentioned or agreed otherwise, the student is obliged to pay the total sum at least 2 months before the beginning of a program.

13.4 In case Proyecto Peru did not receive the total payment in advance, the rest of the payment must be made on the first work day at Proyecto Peru.

13.5 The student must pay for the costs of the international money transfer. Only the net amount received is regarded as the payment.

13.6 In case Proyecto Peru doesn’t receive the payment on time, Proyecto Peru reserves the right to cancel the reservation or stop the program.

13.7 The prices of Proyecto Peru are in Peruvian Nuevos Soles. Payments are in USD $ according to the current exchange rate.

Article 14: Final Clause

14.1 The invalidity of certain clauses of the present terms & conditions does not cause the invalidity of the whole terms & conditions.
